Movie Theater Lawsuits: Commercials, Lack Of Security And More Cinema Legal Trouble

Movie Theater Lawsuits

This past week, a Michigan man filed a lawsuit against his local theater over its high snack prices. According to the Detroit Free Press, Joshua Thompson is suing AMC Livonia after he paid $8 for a Coke and a pack of Goobers (he allegedly spent $2.73 on the same items at a local drug store).

While experts claim that Thompson has no shot at winning this case ("Movie theaters are regulated, so the lawsuit won't go anywhere," said consumer lawyer Ian Lyngklip), he isn't the first individual to fight the legal battle against their local cinema.

In recent years, moviegoers have brought lawsuits against theaters over everything from lack of security to commercials playing before the film starts.

In honor of Joshua Thompson's quest for cheaper soda and candy, let's take a look at five other lawsuits against cinemas.

MOVIE THEATER LAWSUITS:

  • Commercials Before Movies

In 2003, Gregory Scott sued local Chicago theater chain Classic Cinemas for subjecting him and fellow moviegoers to advertisements before the film. <a href="http://www.npr.org/templates/story/story.php?storyId=1176316" target="_hplink">As Scott told NPR</a>, "In my opinion, the theater is engaging in consumer fraud ... What they do is publish start times for films and these start times are reflected on the front of the ticket, which in essence is a contract. They violate the contract by not beginning the movie or even the trailers at that time, rather beginning with commercial advertisements for products." [PHOTO: Flickr/Ron Cogswell]

  • Lack of Closed Captioning

In 2010, <a href="http://www.sfgate.com/cgi-bin/article.cgi?f=%2Fc%2Fa%2F2010%2F11%2F30%2FBAMJ1GJO6I.DTL" target="_hplink">the theater chain Cinemark was sued</a> for refusing to install closed-captioning equipment in their facilities. Eventually, <a href="http://www.sfgate.com/cgi-bin/article.cgi?f=/c/a/2011/04/26/BAKI1J7NKM.DTL" target="_hplink">the lawsuit was settled</a> and Cinemark put in the devices, first in their California cinemas, where the suit was filed, and then <a href="http://www.digitalcinemareport.com/Cinemark-closed-captioning" target="_hplink"> in all of its first-run theaters</a>. A similar lawsuit was <a href="http://www.allbusiness.com/services/amusement-recreation-services/4557744-1.html" target="_hplink">filed against Regal in 2004</a>. [PHOTO: Flickr/Slideshow Bruce]

  • Lack of Security

In 2010, <a href="http://www.sjl-law.com/lawyer-attorney-1611238.html" target="_hplink">a lawsuit was filed against a Regal Cinemas</a> chain in Atlanta after a fatal shooting took place in the parking lot. The suit alleged that the theater provided insufficient security and was slow to respond to the fight that lead to the death of 21-year-old Jesus Pacheco. [PHOTO: Flickr/miss-britt]

  • Bad Seats For Patrons In Wheelchairs

In 2000, <a href="http://articles.marketwatch.com/2006-01-09/news/30955767_1_wheelchairs-stadium-style-national-amusements" target="_hplink">the National Amusements theater chain was sued</a> for failing to give patrons in wheelchairs views comparable to individuals without disabilities. The eventual settlement resulted in National Amusements having to provide improved lines of site for moviegoers in wheelchairs. (<a href="http://adasoutheast.org/news/articles.php?id=5020" target="_hplink">A similar lawsuit was brought against Cinemark in 2004</a>.) [PHOTO: Flickr/Svadilfari]

  • Overaggressive Movie Theater Manager

In 2009, 22-year-old Samantha Tumpach was arrested for filming a few minutes of "Twilight: New Moon," at a Muvico Theater in Illinois. However, <a href="http://www.wired.com/threatlevel/2010/07/woman-suing-theater/" target="_hplink">Tumpach countersued the theater for $50,000</a>, claiming that the manager there demanded her arrest -- despite the police department's reluctance to do so -- in order to collect a $500 reward (the MPAA rewards cinemas who catch and turn in individuals pirating films). Why are trailers so loud?

I've managed to go 2 hours without eating. It's difficult, but can be managed. But if you must snack during a movie, and aren't willing to pay that much, wear something with pockets (or a purse). Just stop clogging up the courts with crappy lawsuits.

i am a big moviegoer and the concessions are a rip off. i bring my own popcorn and water. cost me nothing. i also notice that most of the people that buy these expensive snacks are overweight and look like they can barely pay for the high price of the movies. I GUESSS THATS ENTERTAINMENT.

Look at all the krummie adv we have to put up with on the web.
soon all we will have is adv.----like Cable---when it started they said " now you have to pay--there will be no adv,"
NOW--WE HAVE ABOUT 35 MIUTES OF EVERY HOUR AS AN ADV. & WE ARE PAYING 10 TIMES WHAT WE PAID BACK THEN.

When you go to the movies you have to expect things to be expensive, especially snacks. I used to be a manager at a theater and I can tell you that a theater does not make alot of money at the box office. Most of that money goes to the various movie companies that made the film you are watching. So, to make up for that money, they hike up concession prices. Also, I've never seen any adds/commercials past the time the movie is supposed to start. The movie or the previews anyways have always started right on time. The commercials are usually airing for that 20 or so minutes before a movie starts. By contract though, each theater has to run so many trailers for each movie. You're not going to avoid those at all.

You may not agree with me, but you know I'm right.

My family no longer goes to movie theatres and we haven't for the past six years. We are three people. 1 movie. Cost $48.00 just for the movie at an AMC Clearview theatre in Parsippany, NJ.
I asked why so much? The movie. Okay. 3D glasses. Okay, I paid $3 each, so we took those home. I considered it a purchase, not a rental, and nothing indicated otherwise. Then they said "maintenance of equipment surcharge." I asked what's that? "Well, we have to replace the projector bulb when they go." Isn't that part of your ticket purchase?

They also refuse to honor their own "Coupon Books" which are given to me by a few customers I have. They told me that it's not them, but the books are supposed to be honor by the chain, right? They won't get my money any more. My TV has a 55 inch screen, and Verizon usually has most rentals available on the day they are released anyway.

I wonder how much movies cost now?

Losers of lawsuits should pay for all legal fees.
That includes the losing lawyers

Am I the only one who actually LOVES seeing previews? I love seeing what books will be adapted next and what new animations are going to be coming out. I remember the first time I saw, years ago, the Fellowship of the Right coming attractions, I nearly jumped out of my chair and shouted "YES, MY PRECIOUS, YES!"

Does no one else just really enjoy those commercials?

It is my understanding that the movie theaters make their monies on the concessions and not the ticket sells as these theaters bid for the movies themselves. What I would like to see, for my money, is an usher, in each theater, to stop the texting, loud talking and overall rudeness of those who do not know how to act in public. I would pay more for that. While I love watching movies at home on DVD, there are certain movies that I love to see on a huge screen.

Or if i go to the movies, i bring my own snacks, chips, soda, candy... i just stick it in my backpack.

Just boycott the movie theatres. I just buy the dvds from Bestbuy and watch it at home on my 55'' LED HDTV, screw driving to the theatres, buying the ticket, and then the food, screw all that .

You have a choice, go to the movies or wait until they come out on DVD and buy them. Usually a first run movie is out on DVD in three months. I would rather watch it from the comfort of my own home, eat what I want, pause it to go to the bathroom and my feet don't stick the floor at my house.

He only paid $8.00 for his movie snacks? I somehow bought $13.00 worth of food and I was only carrying 2 items (large nachos, large drink)......I guess people could stop eating at the movies. Why do we do that anyway?? :oO

You eat because of the commercials, not to mention that if your date fills up on popcorn, you don't have to spring for dinner too! LOL
